Why Artemis?
The Financial Services industry continues to grow from strength to strength in the Cayman Islands based in part on its sterling reputation for service and good governance. Regulation and regulatory oversight play a large part in this success and the introduction of the International Tax Co-operation (Economic Substance) Act (“Economic Substance legislation”) during the first half of 2019 was another positive step in the island’s development. Along with the Act and its various revisions and Amendments, a series of guidance notes and guidelines have been published to provide greater color to corporate entities and their advisors. However, the design of solutions and full compliance with regulations remain a somewhat opaque intention.
Artemis has taken the time to discuss the legislation and the practical issues surrounding compliance with the Economic Substance Test with almost every regulatory lawyer on the island. We have spoken with several members of the Department for International Tax Cooperation (“DITC”) and the Cayman Islands Monetary Authority (“CIMA”) to understand their position on the interpretation of the rules. And we have talked with literally hundreds of entities that have found themselves within scope of the legislation. We know what clients would like to achieve, we understand their pain points and we have implemented efficient and effective solutions to help them reach their specific goals. We are also the first to say if we feel a practical and pragmatic solution is unlikely to be found.
